So much for reconciliation hopes…
We think it’s safe to say Olivia Wilde and Jason Sudeikis are FAR from getting back together (despite recent speculation) given the status of their child custody battle! The duo share 8-year-old son Otis and 6-year-old daughter Daisy, who have been the center of legal complications ever since their parents’ messy split in 2020.
Per DailyMail.com on Friday, the exes are headed to court later today in Los Angeles to hash it out over the logistical aspect of their legal battle. During the hearing, a judge is expected to decide whether the former couple’s custody battle should be determined in California or New York. As you may recall, the Don’t Worry Darling director has been advocating for the sitch to be addressed on the west coast, where her kids primarily live.
Upset by this, the Ted Lasso star started arguing New York is the appropriate venue and where the children primarily live, but a judge determined that New York was not the kids’ home and therefore dismissed his petition last year. He then filed a new motion to halt the California order… leading us to today when it will all be decided once and for all.
According to new court papers obtained by Daily Mail, the actress is arguing Jason is only trying to “litigate her into debt” via this new petition — something he can do because he’s far more wealthy. Her lawyers wrote:
“While Jason can afford to spin his wheels with filing after filing, Olivia cannot.”
Of the LA vs. NYC battle, they added:
“Jason seems intent on throwing whatever he can against the wall to see what will stick, and this Request for Order seeking a stay of the California Parentage action is just the latest example.”
The 39-year-old also insists the matter has already been settled and that the comedian is “obfuscating” in his bid to have the future hearings held in Brooklyn, adding:
“Jason should not be permitted to litigate Olivia into debt, and then claim she should be deprived of her right to seek a needs-based fee contribution from him.”
It is currently unclear how much the Horrible Bosses alum makes — because he refused to share the details of his checkbook with his baby momma — but Wilde’s lawyers are certain he has more than their client, noting:
“While the details of Jason’s finances are presently unknown as he refused to substantively respond to basic discovery, she is aware that he is far wealthier than she is.”
Draining Olivia’s wallet is certainly a brutal way of seeking revenge after their disastrous split — which saw Jason allegedly super jealous and distraught over Olivia’s relationship (and alleged affair) with Harry Styles, whom she dated for nearly two years before their November breakup.
But most of all, the mother of two is upset at the way the 47-year-old has been acting “in bad faith” while debating the future of their little ones. Not only did she get mortified in front of thousands of industry professionals when she was served papers MID-SPEECH during CinemaCon, but now she claims Jason has withheld pivotal information from her team, she said in a declaration:
“I thought things were calming down and were going to move forward in a more amicable, respectful fashion. Instead I learned on January 10, 2023 that the entire time I was negotiating the parenting time schedule in California was plotting to proceed with the New York Child Support proceeding behind my back. Apparently he had learned that the court date for our first appearance was January 4, 2023 and purposefully did not advise me of it, nor did his lawyer advise my lawyers. Not knowing the date, neither I nor my lawyers appeared. underhandedness and bad faith in these proceedings is astounding. I am completely perplexed at why he believes that engaging in intimidation or trickery will serve him or our children’s best interests.”
