SHOCKING footage shows the moment a British dad was allegedly knelt on by Magaluf security staff – before dying five days later.

Tobias White-Sansom, 35, passed away in hospital after being held down by bouncers and officers from the Spanish Guardia Civil paramilitary.



But his family now say Tobias' organs were "stolen" as a "cover up", meaning the family will never know the truth of how he died.

Speaking exclusively to The Sun Online, brother Max said: "None of his organs were in his body: his brain, his lungs, his heart.

"Anything that would have given us a more accurate report.

"They kept them for 'further testing' – causes of death come from the brain, lung and heart."

Max, who runs a medicinal cannabis firm in Dubai, said the family had struggled to get Tobias' body home for the funeral.

But it was only after that they were informed the 35-year-old's vital organs had allegedly been removed and kept in Spain.

Broken Max added: "They [Spanish authorities] made sure they kept the body long enough so that it would be very difficult for us to do another autopsy.

"It's a cover up basically."

On July 25, Tobias was set upon in Magaluf's Boomerang nightclub after being shirtless on a night out while on holiday.

The "loyal and loving" uncle had only gone out in the Mallorca clubbing mecca to keep his nephews safe.

But after leaving the club to drop Max's son in a taxi, he went back in to retrieve his T-shirt and bag, which had been left at table.

It was then, following a short argument with a bouncer on the door, he was set upon inside and battered senseless.

Semi-conscious Tobias was taken into the street where -according to video seen by The Sun Online and eyewitness accounts – Guardia Civil officers knelt on his neck.

HANDCUFFED IN AMBULANCE

They cuffed him and injected tranquiliser into the dad's body as they continued their barbaric attack.

The Nottingham man's family believe he went into a cardiac arrest and, with his hands and ankles cuffed, thrown into an ambulance.

A report by the ambulance crew who took Tobias to hospital after attempting resuscitation said he was still fully cuffed when his heart stopped.

At hospital Tobias slipped into a coma, before doctors advised his family to switch off life-support – he was recorded to have died on July 31.

The family never got a full report into how Tobias died, with Spanish authorities blaming their brutality on the dad's behaviour.

"They [Spanish police] built a whole case on a four line document: Toby was drunk, he was aggressive, he tried to kill himself, so they tranquilize him and killed him", Max said.

But the Spaniards' story has changed multiple times, inflicting incredible pain and suffering on Tobias's brave family who just want answers.

It's a cover up

Max explained: "They have tried to say that it was an overdose.

"They couldn't provide documents to prove there was a call from the nightclub to the police, then they said their system was down.

"Then the CCTV at the nightclub was not working, then it went missing.

"They have not cooperated in any way."

When the British government received Spanish autopsy files they told the family a UK investigation was needed – highlighting concerns in the report.

But this was made impossible following what the family say was theft of Tobias' vital organs, which remain in Spain.

Five months on, Max says his brother's death was "categorically a killing" at the hands of "police brutality and murder".

He does not believe people set out to kill his brother, but the brutality in which they are allowed to act must be stopped.

"I want someone to be held accountable", the defiant brother says, "there is going to be more and more of these cases".

Discussing Christmas without Tobias, Max added: "His children have done this beautiful thing where Toby is buried where they have sent a letter to Santa.

"It's a letter to heaven for Christmas.

"Watching them do those letters is just heartbreaking – it is something a one and four year old should never go through."

The dad had over 10,000 people turn up to his vigil, an inquest into his death will take place next year.

The Guardia Civil previously said in a statement: "Upon the arrival of the Guardia Civil police, this man was violent and police reduced him to be assisted by medical services.

"He was taken to the hospital for treatment. There, once while he was being assisted, he was arrested for a crime of injury."

A Foreign and Commonwealth Department Office spokesperson said: "We have provided consular assistance to the family of a British man who died in Mallorca.”

The Guardia Civil did not give a comment in regards to the whereabouts of Tobias' organs.
