Prince Andrew could make Virginia Giuffre prove that the photograph of the two of them together is real, a lawyer has claimed.

The Duke of York has demanded a jury trial in the civil suit brought on by Ms Giuffre after she made allegations of sexual assault against him.

The allegations from Ms Giuffre in this civil case say the three assaults took place when she was 17.

Andrew released a statement denying all the accusations against him 41 straight denials of the alleged victim's claims.

He has continued to not accept or deny the photo of him and Ms Giuffre at the home of convicted sex trafficker Ghislaine Maxwell, who is also in the picture, exists and mentioned it in his complaint filed this week.

Lawyer Rachel L. Fiset, co-founder and managing partner of Zweiback, Fiset & Coleman, believes the photograph is the “single best piece of evidence that Giuffre has.”

Speaking to The Daily Beast, Ms Fiset believes Andrew will “seek an expert’s opinion on whether or not it is real.”

She said: “The photograph may be the single best piece of evidence that Giuffre has going forward in this case. It corroborates Giuffre’s story and appears to place Andrew with another prominent member of the alleged Epstein conspiracy (Maxwell) at the location of the alleged abuse.

“This case would likely not have garnered the amount of media attention it has without the photograph because the photograph, at the least, makes her story credible.”

Andrew’s refusal to accept or deny the photo is included in recent court documents but was also mentioned in his car crash Newsnight interview.

Speaking on the programme, Andrew said: “From the investigations that we’ve done, you can’t prove whether or not that photograph is faked or not because it is a photograph of a photograph of a photograph.

“Nobody can prove whether or not that photograph has been doctored but I don’t recollect that photograph ever being taken.”

He went on to say that showing “public displays of affection are something i do”.

Andrew added: “So that's the best explanation I can give you and I'm afraid to say that I don't believe that photograph was taken in the way that has been suggested."

Ms Giuffre has repeatedly insisted that the photo is genuine and told BBC Panorama that she gave it to the FBI for their investigation.

She also claimed a date can be seen on the back from when it was printed.

In paragraph 38 of Ms Giuffre’s suit it reads: “The below photograph depicts Prince Andrew, plaintiff, and Maxwell at Maxwell’s home prior to Prince Andrew sexually abusing plaintiff.”

Andrew’s response to the allegation said: “Prince Andrew lacks sufficient information to admit or deny the allegations contained in paragraph 38 of the complaint.”
