Woman suing Heinz for $5million because mac and cheese takes too long to cook

The makers of an instant macaroni cheese snack are being sued for $5 million by an angry mum who says that it doesn’t cook as quickly as the instructions suggest.

Velveeta Shells & Cheese is, according to the packet, “ready in 3½ minutes”. But Amanda Ramirez, of Hialeah, Florida, claims the text on the packaging is “false and misleading.”

She says that while the mac’n’cheese needs three and a half minutes in a microwave, there are a number of other steps in the preparation that aren’t accounted for.

Lawyers acting for Ms Ramirez says that manufacturers Kraft Heinz don’t mention four other essential four steps required to prepare the snack: removing the lid and sauce pouch, adding water, microwaving, and stirring.

The lawsuit she’s brought against Kraft Heinz states that it’s impossible for the mac and cheese to be ready in just three and a half minutes, according to the complaint.

Ms Ramirez’s lawyers say Kraft Heinz is unfairly profiting from false advertising, and exploiting customers’ trust in their brand.

Ms Ramirez’s lawyers argue that the company uses the tempting “ready in 3½ minutes” promise to help sell Velveeta Shells & Cheese at “a substantial price premium”.

Ms Ramirez says in her complaint that she is one of many consumers, who try to “stretch their money as far as possible when buying groceries”.

She claims that she she “paid more for the Product than she would have paid and would not have purchased it or paid less had she known the truth.”

Ramirez says the “misleading” marketing is grounds for legal action – to the tune of $5million.

Kraft Heinz Foods Company dismissed the lawsuit as “frivolous” in a statement.

“We are aware of this frivolous lawsuit and will strongly defend against the allegations in the complaint,” a Kraft Heinz Foods Company spokesperson told CNN.
