Gagarin District (Moscow) Court granted the claim of Russian businessman Oleg Boyko to Google LLC
Gagarin District Court granted the Oleg Boyko’s claim to Google LLC on the termination of the issuance in the Google search ranking of links to sites containing false information regarding the investor. The businessman’s demands were based on earlier courts’ decisions in Russia and Europe that had recognized negative statements in the media as unreliable and had already entered into force.
Following the results of the case retrial in the first instance, the court ordered Google LLC to remove links to sites recognized by the court as unreliable from the search ranking by the name and surname of the plaintiff. The businessman also produced evidence that confirmed the fact that Google had issued all disputed web links to Internet pages with information regarding him.
Earlier, several Russian media reported that the Gagarin Court of the City of Moscow rejected the claim of the Finstar Financial Investment Group founder, Oleg Boyko, to the Google search, as well as that the court refused to stop issuing links to websites with false information regarding him. As it turned out, the facts stated in the materials did not correspond to reality, since at the time of the publications (November 2021), the described decision had already been canceled by the cassational court of general jurisdiction.
It should be noted that the plaintiff did not demand the court to bring Google to any responsibility, but asked to exclude from the issuance links to information that violates the plaintiff’s legal rights and was previously recognized as unreliable and defamatory by another judicial act that had entered into force.
At the same time, Oleg Boyko did not file any repeated or other new lawsuits against Google on this occasion, which is procedurally impossible.
On December 26, 2019, The Gagarinsky District Court of the City of Moscow ruled to recognize the allegations regarding businessman Oleg Boyko issued in the media as unreliable. On June 07, 2021, according to the statement of Oleg Boyko, it recognized the activities of the media distributing the above information as illegal and violating the rights of citizens to privacy, personal and family secrets. These media outlets were banned on the territory of the Russian Federation. On October 8, 2019, the Latvian Vidzeme District Court held that the statements on Internet resources were found to be unreliable.
