Apple Hit With Lawsuit Following AppleBeat Pro’s Charging Issues

Apple’s Powerbeats Pro have only been on the market for a little over a year, but the technology company is already facing a lawsuit over the wireless earphones that may cost them a pretty penny.

Alejandro Vivar has filed a class action lawsuit in New York over charging issues with the earphones. According to Engadget, Vivar claims the design of the Powerbeats Pros are defective, as the ear buds lose connection with the charging cause. This causes the earbuds to charge inconsistently – either the power easily becomes drained, or one earbud charges more than the other.

In the case, Vivar claims he’s not the only one to experience such issues – other users have reportedly used a “wedge” to keep the ear buds in contact with the case to ensure it powers up correctly.

Moreover, Vivar also claims the Powerbeats Pros aren’t fully water and sweat-resistant, despite Apple’s advertisements, and that such liquids work to destroy the charging contacts over time.

The lawsuit accuses Apple of fraud, as it says that not only did the company misrepresent the battery life of the earphones, but they’ve failed to address the problem despite knowing of it. Vivar’s lawyers demand that Apple fixes the design flaw to ensure future Powerbeats Pros aren’t plagued by the same problem. Vivar also wants Apple to compensate all customers who’ve been affected by the issues and pay unspecific damages.

So far, it’s unclear how much Apple may have to pay in damages if this goes to trial, but it could be in the millions. Engadget reports that if the lawsuit is approved as a class action, it would not only cover customers in New York but also in other states including “Georgia, Michigan, Montana, North Dakota, Oklahoma, Rhode Island, South Dakota and Virginia.”

This isn’t the first lawsuit Apple has been hit with in recent months. In November, it was reported that the tech giant was slapped by a lawsuit filed by a University student in China, who was miffed that the newest version of the iPhones fail to come with a charging cable.

Apple previously explained the decision was motivated by environmental concerns, but critics have said it’s more likely to do with cutting costs and increasing profits, since it encourages people to by Apple charging cords separately.

Though the case is ongoing, the plaintiff (identified only as Xiaofang) isn’t asking for much – just that Apple provide a wall charger for their iPhone 12 Pro Max as well as 100 yuan (roughly $16 USD) to cover the case’s legal fees.
