With an estimated net worth of $400 million, Reese Witherspoon has a lot to lose form her ongoing divorce from Jim Toth. However, there’s reportedly a prenuptial agreement in place that’ll dictate what the exes walk away with.
Earlier this month, it was reported that Reese had begun court proceedings to process the divorce after publicly announcing the split on social media, days before their 12th wedding anniversary. Reese married Jim, a talent agent, in 2011.

“We have some personal news to share,” the joint statement said. “It is with a great deal of care and consideration that we have made the difficult decision to divorce. We have enjoyed so many wonderful years together and are moving forward with deep love, kindness, and mutual respect for everything we have created together.”
“Our biggest priority is our son and our entire family as we navigate this next chapter. These matters are never easy and are extremely personal. We truly appreciate everyone’s respect for our family’s privacy at this time,” it continued.
According to PEOPLE, court documents reveal that Reese is asking their assets to be divided according to the terms of their prenup. Moreover, Reese requested that she and her estranged husband both be named joint custodians of their only child, son Tennessee.
For now, the details of Jim and Reese’s prenup aren’t publicly known. Though Jim is reportedly worth $20 million, Reese’s fortune is significantly larger, so it’s possible she may have to pay child support or spousal support, unless their prenup states otherwise.

This isn’t Reese’s first high-profile divorce, but it is apparently the first one she’s gone through in which a prenup is in place.
The Legally Blonde star was married to actor Ryan Phillippe from 1999 to 2008, and reports say the two didn’t get a prenup before tying the knot. The exes share two now-adult children.
It’s not clear how Ryan and Reese split their assets upon divorcing – the exes have blamed being young as the reason for their break-up – but some reports suggest they actually made money in the process. The former couple made a slight profit selling the home they used to share in 2014. They apparently kept it for several years after divorcing in order to help facilitate co-parenting.
